Who Pays Attorney Fees?
Contingency Fee or Pay in Advance
When you hire a lawyer to represent you, the lawyer will either agree to represent you on a contingency fee basis, or they will take your case initially with a retainer fee with additional moneys to be paid as needed to proceed with your legal claim.
A contingency fee occurs when the attorney accepts your case with no upfront money or additional fees being requested or paid from the start of your legal claim through the completion of the case. Upon completion of your legal claim, if you are successful, the attorney fees and costs will be paid as a predetermined percentage of the settlement or monetary award amount. The monetary percentage the law firm is paid is determined in your attorney – client representation agreement that is signed when you agree to hire the law firm to represent you.
