What About Pedestrian Accidents Involving Motor Vehicles?
The duty of a driver extends not just to other vehicles on the road, but to pedestrians as well. A pedestrian is anyone walking on the sidewalk or crossing the street; or anyone in a wheelchair, motorized vehicle, and recreational vehicles like skate boards, roller blades, or scooters. Bicycles do not fall under this category and will be discussed at another time.
Drivers must watch out for children and older adults as they tend to walk outside of crosswalk areas. Pedestrians are not without their own duties under Florida Law, but motor vehicles have a heightened duty. Better to err on the side of caution. Texting today is contributing to more pedestrian accidents. It is not possible to text and keep your eyes on the road.
In Florida, if a pedestrian is hurt in a motor vehicle accident, their own PIP, or Personal Injury Protections will cover care of injuries up to the mandatory $10,000.
If the pedestrian does not have a car, it is possible for the driver of the motor vehicle’s Pip to cover these expenses. You would need Your Personal Injury Attorney, Steen James Brown 407-344-3400, if the driver of the motor vehicle is hurt and there is not enough to go around. It will take attorney negotiation in this case.
