It is not uncommon for a personal injury victim to hire an attorney, that he or she later becomes uncomfortable with, be unsatisfied with, or lose faith in the his or her attorney. If this is your current situation, you are not required to continue using your current attorney.

If your attorney is not calling you back, he or she is not listening to you or forgets what you have discussed about the case, or making decisions about your case without consulting with you first, you have every right to make a change in who will represent you going forward.

Having said that, there are some issues that you may have to address if you choose to make a change your attorney.

1. Read your representation agreement to see if you are required to inform your current attorney before you hire new legal representation to represent you.
   
   
2. Understand that even if you change your legal representation, the attorney that you fire may be able to attach a lean against your potential settlement depending on your previous attorney’s claim for billable hours, out-of-pocket expenses, or the terms of your prior representation contract with your previous attorney.
   
   
3. Bring a copy of your previous legal representation contract to your prospective new attorney, so you can be made fully aware of your legal rights regarding a change of legal representation.
   
   
4. Even if your previous attorney does have an initial right to legally place a lean against your settlement, this does not always mean you are legally bound to the terms of the representation contract if it is deemed that the attorneys actions or inactions created a breach of contract or a case of legal malpractice can be established.
